MindFlow Terms and Conditions

1. Introduction

Welcome to MindFlow (the App), an interactive self-reflection tool owned and operated by The White Owl LLC ("Company", "we", "us", or "our"), a Delaware Limited Liability Company.

MindFlow is not therapy, counseling, or medical treatment. It is a self-guided tool for users to explore thoughts and dreams through AI-generated responses and prompts.

By downloading, accessing, or using MindFlow, you ("User" or "you") agree to these Terms and Conditions ("Terms"). If you do not agree, do not use the App.

2. Eligibility

To use MindFlow, you must:

• Be at least 18 years old;
• Have the legal capacity to enter into this agreement;
• Use the App for personal and non-commercial purposes only.

3. Purpose and Nature of MindFlow

MindFlow is intended for personal exploration and self-reflection. It provides:

• AI-generated prompts and responses
• Follow-up questions to incorporate user subjectivity
• A structured framework for thought and dream analysis

MindFlow does not provide therapy, medical advice, or professional psychological counseling.

4. Psychological Risk Disclaimer

IMPORTANT NOTICE: POTENTIAL EMOTIONAL DISTRESS

• Some users may experience strong emotional reactions when reflecting on their thoughts or dreams.
• If you have a history of anxiety, depression, PTSD, or any mental health condition, you should consult a licensed professional before using MindFlow.
• If you feel distressed while using MindFlow, stop immediately and seek support.
• In case of crisis, call emergency services or a mental health hotline in your area. MindFlow is not a crisis intervention tool.

You acknowledge that you use MindFlow at your own risk. The White Owl LLC is not responsible for any psychological distress, emotional reactions, or consequences resulting from App usage.

5. No Medical, Psychological, or Legal Advice

MindFlow is for informational purposes only and should not be relied upon for:

• Therapeutic guidance
• Medical or psychological treatment
• Legal or professional decision-making

If you require mental health support, consult a licensed therapist.

6. AI-Generated Content Disclaimer

AI-Generated Responses May Not Be Accurate or Appropriate

• MindFlow utilizes AI technology to generate responses.
• These responses are not moderated or reviewed by a human and may contain inaccurate, misleading, or inappropriate content.
• Users should apply their own judgment when interpreting App-generated content.

You acknowledge that MindFlow's responses are AI-generated and should not be taken as factual or authoritative.

7. User Responsibilities

By using MindFlow, you agree that:

• You assume full responsibility for how you interpret and apply App content.
• You will not rely on the App for medical, legal, or mental health decisions.
• You acknowledge that dream analysis is subjective and results may not align with your expectations.

8. Privacy & Data Protection

MindFlow does not sell or share user data. For full details, refer to our Privacy Policy.

• Security Measures: Data is encrypted and stored only as long as necessary.
• Deletion Requests: Users may request to delete their data at any time.

9. Limitation of Liability

To the maximum extent permitted by law, The White Owl LLC and its owners, officers, employees, and affiliates shall not be liable for:

• Any emotional distress, psychological impact, or mental health outcomes arising from App use.
• Any decisions, actions, or interpretations you make based on AI-generated responses.
• Any inaccuracies, omissions, or unintended consequences of using the App.

YOU USE MINDFLOW AT YOUR OWN RISK.

10. Indemnification (Hold Harmless Clause)

By using MindFlow, you agree to indemnify and hold harmless The White Owl LLC, its owners, officers, employees, and affiliates from any:

• Claims, damages, or liabilities related to App usage
• Emotional distress, psychological effects, or personal decisions made based on MindFlow responses
• Any direct or indirect consequences of using the App

Users waive any right to claim damages against The White Owl LLC for any issues arising from their use of MindFlow.

11. Governing Law & Binding Arbitration

Mandatory Arbitration Agreement

• All disputes shall be resolved through binding arbitration in the State of Delaware.
• Users waive the right to sue in court or participate in class-action lawsuits.
• Arbitration shall be conducted under the rules of the American Arbitration Association.

Governing Law: These Terms shall be governed by the laws of the State of Delaware.

12. User Agreement Confirmation

Before using MindFlow, you must confirm that you have read and agree to these Terms:

I confirm that I am at least 18 years old, understand that MindFlow is not therapy, and agree to the Terms and Conditions. I acknowledge that The White Owl LLC is not responsible for any actions or decisions I make based on AI-generated responses. (Users must check this box to proceed.)

By using MindFlow, you acknowledge that you have read, understood, and agreed to these Terms.

13. Subscriptions and Gift Purchases

MindFlow offers paid access through two purchase models:

A. Auto-Renewing Subscriptions

MindFlow Premium is available as monthly and annual auto-renewing subscriptions, purchased through the Apple App Store or Google Play Store. The subscription title, length, and price are displayed in the App at the time of purchase.

• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation must be managed through your Apple ID account settings (iOS) or your Google account settings (Android). We do not directly process cancellations.
• Refunds, where available, are issued by Apple or Google per their respective refund policies. The White Owl LLC does not directly process refunds for subscription purchases.
• Free trials, where offered, automatically convert to paid subscriptions at the end of the trial unless cancelled before the trial ends.

B. Gift Purchases

MindFlow Premium may also be purchased as a one-time Gift in 1 month, 3 months, or 1 year durations. Gift purchases are not subscriptions and do not auto-renew.

• The purchaser of a Gift does not receive Premium access from the Gift purchase. Premium is granted only to the recipient who activates the Gift.
• Upon purchase, the buyer receives a unique activation link to share with the intended recipient. The recipient activates the Gift by following the link and signing in with their MindFlow account.
• Once activated, the gifted Premium period begins on the date of activation and is non-extendable. The Premium grant is permanently tied to the redeeming user's account and is non-transferable after activation.
• Gift activation links remain valid until activated. Unactivated Gift links may be eligible for refund through Apple or Google within their respective refund windows. Once a Gift has been activated, the purchase is non-refundable.
• Activation links are not tied to a specific recipient at the time of purchase. Whoever first activates the link receives the Gift. The purchaser is responsible for sharing the link securely with the intended recipient.

C. Payment Processing

All payments are processed by Apple (App Store) or Google (Google Play). Use of the App Store and Google Play is subject to their respective terms of service. The White Owl LLC does not collect or store payment card details.
